What does that mean for Harvey Weinstein’s conviction in California? New York and California each have their own state evidentiary rules – in New York, the courts preclude testimony from witnesses about crimes that the defendant is not charged with; in California the rule is different. Each case will be tried in accordance with its state rules. While it’s unnerving to think that Weinstein has “gotten away with it,” his California conviction still stands.
Does the reversal give credence (pooh pooh, god forbid) to men’s cries that the #MeToo movement excoriated men for being men, interfered with the way people interact and work and went too far? Well, convictions or otherwise, many men expressed their frustration with #MeToo. But women have consistently found their voice, they have been emboldened by #MeToo long after 2017.
